Photography Contest Model Release

For photographers entering photos of their own children:
By entering this contest, I agree to release the City of San Buenaventura (Ventura), its agents, its employees, and its certified volunteers from and against any claim arising from my or my child's participation in a program sponsored by the City of Ventura. I grant permission for the City of Ventura to use participant's image, filmed during program activities, to promote its services and programs. I agree to indemnify and hold the City of San Buenaventura harmless from and against any claims, whether caused by passive negligence or otherwise. I will pay all costs incident to any claim, including, without limitation, attorneys' fees. I agree that this agreement is intended to be as broad and inclusive as is permitted by law of the State of California.  

For photographers entering photos of models other than their own children:
I agree to the waiver above, and affirm that by when providing the contact information for the model with the entry image, I have secured his or permission (as well as the parent or guardian’s permission for models under 18 years of age) to have the model’s image recorded for use in this contest.

All photographers agree to the same “Image Requirements,” “Entry Agreement” and ”Hold Harmless” requirements as the annual City of Ventura Photo Contest (read below). Please note that the categories (see above) for this July contest are different than for the annual contest (below).

2012 CONTEST: Enter from Jan 3 to Nov 1, 2012 - Vote Nov 6-13 - Results & Exhibit in Dec

Amateur and professional adult and youth photographers are invited to enter their best images celebrating our community in the ninth annual City of Ventura Digital Photography Contest between January 1 and November 1, 2012. Photos must be taken within or directly adjacent (i.e., beaches, Channel Islands, etc.) to our city limits. Judging in November is by photography professionals and community leaders who will select images that best depict Ventura in six categories (see below). The public is invited to vote on-line between November 7-13 for the People's Choice awards. All participants are invited to a City Hall Bridge Gallery exhibit of winners in December and all entries are eligible to be featured in citywide publication of print and electronic media with photo credit. Photographers may enter the 2013 contest starting January 2, 2013.

CATEGORIES

Capture Ventura’s beautiful environment, eclectic architecture, active people and vibrant community life and issues, and submit your favorite photographs in these categories:

1. Environmentskylines, open spaces, beaches, parks & wildlife

2. Architectureurban design, cityscapes, landmarks & infrastructure

3. People Portraitsof residents participating in city sponsored events & classes

4. Community Lifeeducation, volunteer, street/nightlife, celebrations, arts & cultural scenes

5. Altered Imagesphotos manipulated for artistic purposes

6. Photo Voiceimages illustrating a community issue or problem 

IMAGE REQUIREMENTS

Eligible images from a digital camera set at no less than 3 mega pixels high resolution or digitally scanned if from a non-digital camera must be in either JPG or PNG digital format at a file size of between 3 megabytes (minimum) and 9 megabytes (maximum) at 300 dpi (dots per inch) of sufficient resolution to print at 8 by 10 inch size without a loss of quality.

File names generated by the digital camera or scan must be RENAMED as follows: enter number of category above (1-6), first and last name of contestant, and short title of photograph without using capital letters, spaces, underlines or dashes. For instance, if Richard Newsham entered an architectural shot of the Ventura Pier he would rename his photo entry: 2richardnewshamventurapier.jpg  —OR—  2richardnewshamventurapier.png

By submitting entries, the contestant acknowledges and agrees to the terms of the contest ENTRY AGREEMENT (read terms below).

ENTRY AGREEMENT

In submitting the attached photo(s) (PHOTO) to the City of San Buenaventura (CITY) and participating in the City of Ventura Photo Contest I (we), (CONTESTANT), hereby warrant and agree to the following:

  • CONTESTANT warrants to CITY that he/she has lawful ownership rights to the PHOTO and acknowledges that once submitted, the PHOTO becomes the property of the CITY.
  • The PHOTO is the result of CONTESTANT'S sole artistic efforts unless otherwise stated above as a collaboration.
  • Except as otherwise disclosed in writing to CITY in this submittal form, the PHOTO is unique and original and does not infringe upon any copyright or patent.
  • The PHOTO is free and clear of any lien. Except for title and possession, pursuant to the Copyright Act of 1976 (17 U.S.C. §101 et seq.), CONTESTANT will retain the copyright and all other rights in and to the PHOTO. The CONTESTANT grants to CITY an irrevocable and non-exclusive worldwide license to reproduce, to distribute, and/or to display two- or three-dimensional reproductions of the PHOTO in any manner whatsoever relating to any CITY publication or event, including, without limitation:
  • Public display as well as reproduction on CITY items, such as print ads, postcards, posters, brochures, applications, television programs and the City website.
  • In addition the CITY will include CONTESTANT'S name somewhere on the document where the photo is used.
  • The CITY may alter images of the PHOTO as necessary to fit into reduced or enlarged format sizes.
  • The CITY may use the PHOTO on CITY merchandise and commercial items which may be sold for fundraising purposes.

Pursuant to 17 U.S.C. § 106A(3) and only to the extent that this Agreement differs, CONTESTANT expressly waives any rights that the he/she may have under Cal. Civ. Code § 987 or 17 U.S.C. §§ 101 et seq., including, without limitation, 17 U.S.C. §§ 106, 106A, and 113, or any successor statute(s) or regulation(s).

HOLD HARMLESS

CONTESTANT agrees to release CITY, its agents, officials, employees, and volunteers from and against all liability, including copyright or patent infringement claims or causes of action, arising out of this Agreement and claims arising from CONTESTANT'S participation in the City of Ventura Photo Contest. CONTESTANT agrees to defend (with counsel satisfactory to CITY), indemnify and hold City harmless and free from all liability, whether caused by passive negligence or otherwise, arising out of CONTESTANT'S participation or association with the City of Ventura Photo Contest. CONTESTANT agrees to pay all costs incident to any claim, including, without limitation, attorneys' fees. I agree that the above information is correct. I further agree that this agreement is intended to be as broad and inclusive as is permitted by the law of the State of California.

Amateur, professional and school-age photographers submitted more than 200 images to the City of Ventura’s eighth annual ‘Take a Shot!’ digital photography contest. Five judges -- professional photographers and community leaders -- selected winners in six adult categories and one youth category while more than 200 members of the public cast their own votes online to select their favorite “People’s Choice” awards. Judges included visual artist and Public Art Commissioner Claudia Pardo, professional photographers John Nichols and Dan Holmes, Cultural Affairs Commissioner and Ventura Unified School District official and arts teacher Maryanne Irving and Community Partnerships Manager Denise Sindelar. “The 2011 ‘Take a Shot!’ digital photography contest received more than 200 online submissions this year capturing from many perspectives the diversity of people and cultures in our community as well as our city’s stunning natural landscapes,” said Sindelar. “With more than 200 community members voting online for the people’s choice awards, this photo contest is both popular and a great tool for expressing community pride.” For more information, contact Marketing Specialist Richard Newsham at 805.658.4706 or rnewsham@cityofventura.net. All participants were invited to a special City Council presentation and Bridge Gallery exhibit reception at City Hall, 501 Poli Street, December 12 at 5:45 pm.
